These General Terms and Conditions apply to enquiries, offers and contracts with consumers and businesses concerning Footballec products, unless expressly agreed otherwise in an individual case.
1. Provider
Footballec Europe s.r.o., nám. T. G. Masaryka 1281, 760 01 Zlín, Czech Republic.
2. Scope
These Terms apply to communication, offers and distribution of Footballec products, including standard editions, configurations and custom editions.
3. Conclusion of contract
The presentation of products on this website constitutes an invitation to submit a binding offer via the order process or by individual enquiry.
A contract is concluded when we expressly confirm the order, accept payment or confirm an individual agreement in writing.
4. Products, configurations and custom editions
Footballec offers both standard editions and individually configured or personalised products. The specifically agreed specifications are decisive for the contract content, especially regarding design, team selection, colours, club reference, packaging, scope of delivery and, where applicable, approval status.
For custom editions and individualised products, minor technical or production-related deviations may be permissible as long as they do not materially impair the agreed overall effect.
5. Prices and additional costs
The individually agreed prices apply. Unless stated otherwise, prices are plus any shipping costs, packaging costs, customs duties or import charges where applicable.
6. Payment
Payment method, due date and any deposits result from the respective offer or order confirmation. Reasonable advance payments may be requested for individually manufactured products.
7. Delivery and delivery time
Delivery periods are binding only if expressly confirmed in text form. For individualised products, a delivery period generally begins only after final clarification of all specifications and, where applicable, receipt of an agreed deposit.
8. Retention of title
The delivered goods remain our property until full payment.
9. Warranty
The statutory warranty rights apply. For consumers, the statutory defect rights apply. In relation to businesses, the statutory provisions of the applicable law and any individual contractual agreements apply additionally.
10. Personalised products
Special rules may apply to products made to customer specifications or clearly tailored to personal needs. This particularly concerns custom editions, club or company editions and individually agreed design and product variants.
11. Liability
We are liable without limitation in cases of intent, gross negligence, injury to life, body or health and under mandatory statutory provisions. In case of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded to the extent permitted by law.
12. Applicable law
The law of the Czech Republic applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions of the country in which the consumer has their habitual residence conflict with this.
13. Place of jurisdiction
If the customer is a merchant, a legal entity under public law or a special fund under public law, the provider’s registered office is the place of jurisdiction to the extent legally permissible. For consumers, the statutory jurisdiction rules apply.
